16.1 If you use a proprietary online service to access the Site, your access and use of the Site are subject to the terms and agreements you have entered into with that proprietary online service.
17. Trade Mark and Copyright Policies
17.1 The Site respects the trademarks, copyrights and intellectual property of others, and expects Users to do the same. The materials on the Site are protected by copyright, trademark, and other applicable laws of the United States and of the State of Connecticut. You may not reproduce, distribute, transmit, publicly display, cache, republish, upload, prepare derivative works based on, or otherwise used Site's materials, including but not limited to text, images, posts, video, code and software ("Materials"), except as expressly permitted in writing by the Site's operator.
17.2 The Site, in accordance with 17 U.S.C. Section 512 as amended by Title II of the Digital Millennium Copyright Act (the "DMCA"), may ask that you stop using the Site and take legal and technological steps to restrict your access to the Site, if it deems at its sole and absolute discretion that you are involved in infringing activities, regardless of whether the material or activity is ultimately determined to be infringing. Additionally, pursuant upon the DMCA Section 512(c), the Site has taken steps for receiving written notification of claimed infringement and for appropriately processing such claims.
17.3 TheBudgetBabe may not be used without the express, written consent of the Site's operator.
17.4 To notify the Site of a possible infringement, please follow the procedure under the "Contacting TheBudgetBabe" section of this Agreement and be sure to include:
(1) identification of the material in question on the Site,
(2) identification of the copyrighted work that may be being infringed,
(3) your contact information including your name, physical address, email address and telephone number,
(4) a brief statement of your good faith concern that there is an infringement taking place,
(5) a brief statement certifying that, under penalty of perjury, all the information you have provided is accurate and factual, and
(6) an electronic signature.
18. Jurisdictional Issues
18.1 This site makes no claim to meeting any standard of legality outside the United States and Users from other nations should be aware that their use of the site may be governed by other laws and standards for which the Site takes no responsibility.
18.2 This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of Connecticut, as they are applied to agreements entered into and to be performed entirely within Connecticut. Any action made to enforce this Agreement or in connection with any matters related to the Site shall be brought only in either the State or Federal Courts located in Connecticut, and all Users expressly consent to the jurisdiction of said courts.
18.3 If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between the parties relating to the matters contained herein.
